“This Tennessee bill will place requirements beyond those found in the Constitution on individuals who choose to run for a congressional seat within the state. If enacted, the new provision would block anyone who hasn’t been a resident for three years from securing their name on the ballot.
“The Constitution lays out congressional qualifications in Article 1, Sections 2 & 3, and the 17th Amendment. This added measure goes beyond that. SB 2616 raises significant questions, will almost certainly be litigated, and likely runs afoul of Supreme Court precedent. States have tried to impose additional requirements before, but the United States Supreme Court has ruled they cannot.”
